Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Trihill LLC (“Trihill,” “we,” “us,” or “our”), the company that provides Avelden. They govern your access to and use of Avelden’s websites, applications, and community-management services (collectively, the “Service”). By creating an account, accepting an order, or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.

1. The Service

Trihill provides Avelden, which includes tools for community administration such as member and unit management, communications, billing workflows, issue tracking, visitor access, file storage, and related features. We may improve or change the Service over time. Material reductions to paid functionality will be communicated when reasonably possible.

2. Accounts and authorized users

You must provide accurate account information and keep login credentials secure. You are responsible for activity under your account and for ensuring that your authorized users comply with these Terms. Notify us promptly at hello@avelden.com if you suspect unauthorized access.

3. Customer responsibilities

You control the information submitted to the Service and are responsible for having the rights and permissions needed to collect, use, and share it. You must not use the Service to:

• break the law, violate another person’s rights, or facilitate fraud;
• upload malicious code or interfere with the Service’s security or operation;
• attempt to access accounts, systems, or data without authorization;
• send unlawful, deceptive, or abusive communications; or
• resell or reverse engineer the Service except where applicable law permits it.

4. Fees, billing, and trials

Paid subscriptions are billed according to the pricing and billing interval presented when you subscribe or in an applicable order. Fees are in the stated currency and exclude taxes unless stated otherwise. You authorize Trihill and its payment providers to charge the payment method on file.

Promotional or free-trial access may be limited or changed as described when offered. Unless you cancel before a paid subscription begins, your selected plan will renew for the applicable billing interval. Fees already paid are non-refundable except where required by law or expressly stated otherwise.

5. Customer data

You retain ownership of data, files, and content submitted to the Service (“Customer Data”). You grant Avelden the limited rights necessary to host, process, transmit, back up, and display Customer Data to provide and secure the Service. Our handling of personal information is described in the Privacy Policy.

6. Avelden property

Trihill and its licensors retain all rights in the Service, including its software, design, Avelden branding, documentation, and underlying technology. Feedback you provide may be used to improve the Service without restriction or compensation, provided we do not identify you publicly without permission.

7. Third-party services

The Service may connect with third-party products, payment processors, or websites. Their terms and privacy practices govern their services. Trihill is not responsible for third-party services that it does not control.

8. Suspension and termination

You may stop using the Service at any time. We may suspend access when reasonably necessary to prevent harm, address a security risk, comply with law, or respond to a material breach of these Terms. Either party may terminate a paid subscription for material breach if the breach is not corrected within a reasonable written cure period.

After termination, access ends and Customer Data may be deleted following a reasonable export or retention period, subject to legal obligations and backup cycles.

9. Service availability and disclaimers

We work to keep Avelden reliable and secure, but no online service is uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data. Trihill’s aggregate liability arising from the Service will not exceed the fees paid or payable for the Service during the twelve months before the event giving rise to the claim. These limits do not apply where the law prohibits them.

11. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or our practices. We will post the updated version and change the effective date. If a change materially affects your rights, we will provide reasonable notice. Continued use after the change takes effect means you accept the revised Terms.
